Altoona Chapter 7 and Chapter 13 Bankruptcy Lawyers

Whether you are an individual in debt or an owner of a small business that is struggling to pay its bills, filing bankruptcy may assist you, relieve your worries, and put you back on track financially.  The lawyers of Evey Black Attorneys LLC can help you achieve relief from your debts.

Our firm handles both individual and small business bankruptcies for clients throughout central Pennsylvania.  The type of bankruptcy our clients choose depends upon their income, the nature of their assets, the amount of debt they have, and their individual and business goals.  An attorney meets initially with clients, reviews their financial situation, and conducts follow-up visits as may be necessary to help clients determine which chapter of bankruptcy would best serve their needs:

  • Chapter 7 bankruptcy results in the discharge of unsecured debt and gives individuals or businesses a fresh start.  In most consumer cases, assets are protected from liquidation.  In limited cases, certain assets may be sold and the proceeds used in part to pay unsecured creditors.
  • Chapter 13 bankruptcy affords clients the opportunity to reorganize and pay a percentage of their unsecured consumer debts off, typically over a period of 3 to 5 years.  At the end of a Chapter 13 plan, any remaining unsecured debt not paid through the plan is discharged.  This may be a good option for clients who have steady income but cannot get caught up on repayment of debts, including delinquent mortgage payments.

Our clients may also need assistance following the finalization of their bankruptcy case.  We advise them on business dissolution matters, rebuilding their credit, and other matters of importance to beginning a new financial life.

Bankruptcy Creditor Services

Sometimes your business encounters a customer who has filed for bankruptcy.  Documents start arriving from the debtor’s attorney and the bankruptcy court, and you do not know what to do.  We can help you evaluate the situation, file a proof of claim if appropriate, and monitor the bankruptcy so you can both comply with the bankruptcy rules as a creditor and also make the best decisions regarding the customer’s debt to your business.  We are also able to provide representation in adversary actions, and if appropriate, file for relief from stay on behalf of secured creditors in order to sell the debtor’s assets.
