Roaring Spring:

These 6 mistakes could lead to a denial of coverage

You submitted a workers' compensation claim with the help of your Holidaysburg employer, but you were shocked when it came back denied. The agency described your claim as inadequate, and you believe that your employer may have added information to suggest that your claim wasn't legitimate despite the truth.

Generally, workers' compensation claims are only denied for a a few reasons. These reasons include:

  • Not having sufficient evidence of the injury being work-related
  • Not having suffered a compensable injury
  • Not receiving medical treatment
  • Not reporting the injury in time
  • Not filing the claim within the time limit
  • Your employer disputes the claim

If any of these are the cause of your denial, then there are some steps you should take to appeal. For example, if you are told there wasn't enough evidence of the injury being a work-related injury, it's a good idea to go back to the medical provider and to have them give you more information on how your injury was caused by your work. If there were witnesses who saw you get hurt on the job, they can also be helpful by submitting written accounts of what they saw happen and allowing the workers' compensation agent to call and speak with them.

Your attorney will support you if you make a claim and it is denied. Your attorney will review the reason for the denial and help you make a plan to appeal the denial and get your workers' compensation coverage approved. If you were hurt in a legitimate accident, then there is no reason for the agency to reject your claim.
