How to negotiate a divorce agreement

People in Pennsylvania who are divorcing do not necessarily have to go through litigation. Most divorces can be settled through negotiation. However, there are some ways a soon-to-be ex can prepare to make sure the process goes as smoothly as possible.

First, spouses should understand their finances thoroughly. This may include putting together financial records such as tax returns, credit card bills and more. A person should have a clear picture of the family finances including assets and debts. The spouse should then speak to an attorney to get an idea of what the best and worst case scenario could be in the divorce. An attorney can also help a person get a sense of the laws around divorce in Pennsylvania and if alimony and/or child support could be warranted.

With this information, it is important for people to think about what they want and need as well as their ex’s wants and needs. The former involves creating a budget and a list of priorities. The latter involves making an effort to understand the ex’s situation.

Mediation is an alternate dispute resolution process than can help a couple reach an agreement without resorting to litigation. The couple may be more satisfied with this solution since they remain more in control of the final decision. Child custody can be a particularly difficult agreement to negotiate because it often leads to heavy emotions. However, parents may be able to reach a satisfactory arrangement by keeping the best interests of the children in mind just as a judge would. A couple might also agree on some aspects of the divorce agreement and need to go to court to settle others.
